New York City free essay sample

New York City by K. L., Weare, NH As we stood in the airport terminal, I admired the voices and laughter of those around me. I began to realize that this would be the last time I would see their smiles and listen to their pleasant accents. It had now come time to say good-bye. As tears filled our eyes, we embraced and told one another that we would meet again, knowing that this was not likely. They boarded their plane en route to France, their homeland. I stood watching them leave and thought back to when we first met. It was on a trip to New York City. I was introduced to 27 exchange students, seven of whom I became good friends with. Taking part in their lives for a few days was an experience I will never forget. During the summer of 1994, my cousin asked me to go to New York City with her and a group of exchange students. We will write a custom essay sample on New York City or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page I was hesitant at first, but I eventually agreed. No sooner were we on the bus than people approached us to talk. Throughout the six-hour bus ride, we exchanged slang terms and explained what they meant. We taught them terms such as Whats up, cool, and cute. They taught us how to greet people and how to ask for directions. They were excited to learn more about English. When we arrived at the hotel in New York, we were assigned to our rooms. It was flattering to hear the others ask if they could room near us. We went to our rooms to unpack. Within a few minutes we heard laughter and people tapping on our door. Needless to say, it was the exchange students. They came into our room and we stayed up for hours talking. We talked about being teenagers and what it meant. One exchange student, Dominique, brought up a very good point. She told us that being a teenager involves finding yourself. This includes the things that make you happy and the path you choose for your future. This conversation was one that I will never forget. I learned a lot that weekend in New York City. I know more about France than I have ever known. I also learned that you should never be afraid or hesitant to meet new faces. Most important, I made seven new friends. Even though they are across the world, I will never forget them. And one thing I will always have is the lasting impressions of their laughter and their smiles.

Criminal Procedure Consequence of Common Law

Question: Discuss about theCriminal Procedure for Consequence of Common Law. Answer: Introduction: In this assignment a case is described where an offense is identified. A person has murdered someone and he did that offense when he was affected. This person is not only a murderer but also a drug addicted criminal. Previously, he had many criminal records and he went to prison many times. In this case, as the person was drunk, so it did not take much time to identify his crime by the police inspector. This assignment discusses how a murder can be convicted under Code of Criminal procedure (CPC), 1973[1]. As per this act, the criminals should be convicted under Criminal procedure act of Australia in the consequence of common law. Body In this case, there is a victim and slaughterer. The slaughterer is a criminal who has killed the victim (Kevin Nguyen) in a very in humanistic manner. After the establishment of autopsy report of Kevin Nguyen, it was found that, Nguyen was stabbed five times in his chest and when he used his arms for defence the murderer stabbed his hands and arms also. As the knife pierced the heart of the victim (Nguyen), so he died. By the broken nose and black eye of Nguyen, it can be identified that, Sutton brutally murdered Nguyen after hitting him with punch for several times. When the police did investigation of the body, he found a man in Hyde Park whose shoes were stained with blood. This gave the police idea that man may be the murderer of Kevin. He was Sutton. He did not answer the question of the police properly but when the police warned them that they will do investigation in his house, and then he revealed the truth that he has killed Kevin because Kelvin has stolen Suttons drugs. All the proof described that Sutton is the murderer but twist came in a part when Sutton said that, he has not stabbed or used any knife to kill Kevin. There are some eye witness who saw the fighting of Kevin and Sutton; they are Jack and Stretch, two homeless alcoholic. Stretch said that, when the fight was going on, there was no knife in the hand of Sutton. So it cannot be clearly said that he is guilty. In this case the police should properly investigate about the case with the help of Criminal procedure act of section 99[2]. As per this act legal investigation is done by collecting evidence and by finding out the real murderer. Committal proceedings should be done to find out the accused person and apply divisions on the case to punish the guilty person[3]. The police have recorded the words of Sutton, when he was revealing the truth. As per section 289D of Criminal act, the recording which was done by the police should be presented to court but problem arises because the interview was taken when Sutton was in drunken condition. So, the police have not got the total evidence against him and for that reason he cannot be proved as accused, even there are some witness Jacko and Stretch who told that Sutton has only fought with Kevin but not killed him; he had no knife in his hand when the fight was going on. So it can be clearly understood that the culprit is someone else who murdered Kevin. As Sutton is not responsible for the death of Kevin, so he can for something to defence his case. Firstly it is necessary that, he should take help of a criminal defence lawyer who can help him to win the case. A criminal defence will first do an appeal to the court, so that he can get more time to find out the actual accuser. The offender appeal against the conviction of Sutton should be done to Director of public prosecution (DPP) and if the appeal is rejected from the court, then the civil defence can appeal the case to high court of Australia[4]. For the appeal hearing evidence is needed to be given by the lawyer in Victim Impact Statement where the lawyer can use Jacko and Stretch the two witnesses who knows that Sutton only had fight with Kevin and he did not killed him. After that, legal and technical discussions can be done where the court decides, whether the appeal should be given or not with appeal hearings. It is the right of the offender, to appeal against the conviction or guilty verdict. The hearings take place in the Court of appeal. Two things can happen if the lawyer appeals for the conviction of Sutton. Whether the appeal can be dismissed or the appeal can be allowed for Sutton by the justice from the court. It is very important that Witness Assistance Service (WAS) should be used and witnessed are brought to court who can talk on favour of Sutton to save him from the allegation which he has not done. There are some ways by which the criminal defence lawyer can fight for the case of Sutton. As per Australian law, if a person has really murdered someone and it is proved then he will be sentenced to life time imprisonment under Criminal act, 1900 of NSW state law for a 20 or 25 years non-parole period. But if he has not murdered anyone but still he is imprisoned, then the defence lawyer can defence under section 23 of Criminal Act 1900. Under this remedy the lawyer can save Sutton but he has to find appropriate proofs to save him and he also has to find the real culprit who has killed Kevin. It is mandatory to be proved that the electronic recorded proof against Sutton was wrong because he stated wrong answers in fear and at that time he was in drunken and drug addiction, so his words cannot be trust. It can be said that he has stolen the blood engrossed shoes of Kevin while fighting was going on but he has not killed him because the knife was not present with him. Not only that, bu t the knife is missing with which the murder was done. So the criminal defence can charge the civil lawyer or his client to find the knife first with which the murder was done, then with the finger print it will be proved that who has murdered Kevin. Even the criminal defence lawyer should also find out the clue by talking with the friends and relatives of Kelvin and he need to find out who were the friends and enemies of Kevin. As Kelvin was addicted with drugs, so it is assured that his friends environment is not good, so any of his friends, enemy or a person related to him can kill him. As Sutton is wrongly imprisoned, so it is very important that guilty confinement procedure should be adopted by the defence lawyer and on the basis of that procedure, extra time should be appealed from the court for Sutton. When the lawyer tried to find witness, Stretch said Jacko had died because of overdose of drugs, but Stretch gave witness that when the murder took place, at that time Sutton w as with Stretch, drinking at the end of the park. A fighting took place between them but after the fight also, Kevin was alive, so it is very necessary to collect the evidence and the witness and presented to court by the defence lawyer, to prove Sutton innocent. In the case of Sutton, the lawyer can also do presumption of innocence[5]. It is the legal duty of the lawyer to find out the proof with criminal trial. Under article 11 of Human right act, in the principle of common law, it is the right of Sutton, that he get chance to prove his innocence[6]. So as the case of Sutton is complicated and no result and declaration of the case is easily available, so the defence lawyer needs time to find out the actual culprit. From the case, it can be clearly identified, that the actual culprit is very clever who has not kept any proof against him; even the knife with which the murder took place was also hidden by him. So it was hard for the lawyer to find out the actual person who has convic ted the crime[7]. Various legal procedures are needed to be applied and as per Bail act 2013 of NSW under section 23, Sutton can be executed from imprisonment for some times and during that time the defence lawyer has to find out the actual culprit who is responsible for the death of Kevin. If the actual culprit is find out then, Sutton will be escaped from imprisonment nave the allegation and the actual culprit will be either sentenced death for misrepresenting law or he can be imprisoned for life time till death of 2 years imprisonment under Criminal act 1900 under section 3[8]. All the process of investigation should be done by the defence lawyer by hiring an investigator who can investigate about the case properly following the Criminal procedure code. In the appeal of conviction, under section 118 notices can be given in appeal and on the code of section 668D (1) (b) the judge trial notice can be given and under section 74 the convicted person can be saved by the defence lawyer[9]. The obligation may arouse because some evidence are against Sutton, such as the blood stained shoe, the place where he was present, the reveal of his own crime etc. It is hard to prove that he is innocent but as per section l72 (2) the defence lawyer of Sutton has to right to get some time and fight against the conviction under which allegation is given to him and if the right culprit is identified then Sutton can Save himself from the allegation[10]. It is the prior responsibility of the defence lawyer to investigate and find out the main culprit[11]. By this way Sutton can appeal conviction and there is chance to prove him innocent. Conclusion This case can be solved under this acts and sections which the defence lawyers can use and if the proper justification of the case is done then Sutton can be saved from the wrong allegation which is given on Sutton. The witness, evidence and various other procedures can help the defence lawyer to find out the real culprit and save Sutton. By this way the real culprit or murderer of Kevin can be identified by the criminal defence lawyer and this can help him to get away from the wrong allegation and rescued. Health and Safety in ICT Essays

Health and Safety in ICT Essays Health and Safety in ICT Essay Health and Safety in ICT Essay If an employer does not care about the health and safety of his employees, they could be sued up to 10,000 pounds. This includes supervision of inexperienced workers. Employees are entitled to safety equipment if it is needed. Employers have to make sure their employers can work machines properly because so they wont get hurt. Employers are responsible for providing their workers with safe and suitable equipment with which to do their job, training them in how to use it, inspecting and maintaining it, and ensuring that it is used correctly through training and supervision. They also need to set up emergency procedures, provide first aid facilities, taking precaution against electrical equipment, noise, temperature and radiation. And giving safety warnings (signs) For an example if office floors were left wet or cluttered with files or cables, on which employees slipped or tripped up. They would have the right to ask for compensation from their employers. Electrical sockets must not be overloaded. It is also important not to have food or drinks near. Section 2 of the Health and Safety at Work Act 1974 states that It shall be the duty of every employee to ensure, so far as reasonably practicable, the health, safety and welfare at work of all his employees. Section 3 of the Act states that It shall be the duty of every employer to conduct his undertaking in such a way as to ensure so far as is reasonably practicable, that persons not in his employment who may be affected thereby are not exposed to risks to their health or safety. If there were no laws regarding health and safety at work, the number of deaths at work places would be much higher. People can be disabled for life due to lack of safety precautions. Ergonomics means the study of equipment design to make workplace equipment more comfortable and safe for people so that they are more efficient in their work environment. Ergonomists design things carefully such as a chair so people dont get pastoral and back pain People working with computers need to think about: * Position of the computer * Placement of the keyboard and mouse * Furniture and posture * Hand in arm position and movement * Angle of the monitor * Lighting * Their vision * Cables and accessories or peripherals. If the position of the computer is too far away from you. You have to squint at the screen hence damage your eyesight. You need a good distance from the keyboard/mouse to support hands/wrists during pauses. Also so you dont strain your arm. You could get severe back pain if your chair was too upright. . You should also be able to adjust your seat height so you are comfortable with looking at the screen. If your screen isnt level with your head and you need to look up. You will get neck pain. Dim lighting strains your eyes. Looking too closely at your screen makes you vulnerable to harmful radiation. Therefore, you need to make sure you are at a reasonable distance from your computer and make sure you have a screen filter. Cables can harmful because a person could trip from cable and break a bone. An accessory such as a printer can be dangerous because you could twist a muscle while getting a printout. Workers also need to take regular breaks because you can collapse from stress. Advantages of ICT Computers have made life much more easier for us. Before computers were invented it could take more than 6 months to get a simple message to Australia. Now it only takes a couple of seconds. Computers are 99% accurate when make calculations E.g. in Microsoft Excel. It can also make you a variety of different graphs in a mille second in Excel. Doing things on a computer makes the final product look more professional than doing it by hand. Instead of writing something out again and again. You could write it out once and print it how many times you want. This saves a lot of time. When you need to change something around on paper you have to write it all out again. But on Microsoft Word you can just cut and paste. On a computer you can almost completely change an image so it looks the way you want. You can rotate it, enhance, brighten it etc. If you take a picture on a digital camera instead of taking it to a shop and paying money you can upload it on your computer. Work is easy to save and document, rather than someone keeping them in folders where they can get misplaced. You can use scanners to scan in pictures form magazine and books which is easier than taking a photograph. It is much easier to read something on the computer than something that is handwritten (bad handwriting). It is also much more easier to search for information. Disadvantages of ICT. Its is difficult to understand a computer and some software/programs so you can need training. Some graphics are to difficult to achieve if done by a computer . As they are complex. When something is done by a computer people have high expectations. Saving and backing up a file can destroy the work and sometimes the computer also if there is a problem with your hardware. Viruses can get into your system and destroy everything . People rely on computers too much and get lazy . Using a computer damages your eyes. Monitors release harmful radiation. Using a computer too much can leads to strain injury , back problems and eye pain. ICT also contributes to global warming. How to safeguard your work Storage and Backup. It is important that when you are naming a file or a folder that you use an appropriate name. Because if you forget where it is, you can search for it by clicking start and then clicking on search (window xp). If you want to rename a folder: you need to click on file and then rename. You cannot use any punctuation. It is good to make more than 1 folder to make it more easier find a file and its more organized. It is important to regularly backup your files. Because your work can be destroyed by a technical problem or a virus. If you want to make a new folder just click right, new and then folder. Using a floppy to backup is a bad idea because most computers are not designed for floppies, they dont have much space (around 1.46 mega bytes), are slow and they are very unreliable. Using a CD is better as they have more space and are more reliable, they can have up to 700MB, relatively inexpensive and new computers have a built in cd-rw drive. . But you need special software to use them, it is possible to overwrite data and lose important files. You can also store date online , The advantages are : you can access your data anywhere, offers large amount of storage , no other device needed. The bad thing is if the companys server fails you will not be able to access your data, your information can be stolen by a hacker , you often have to pay a monthly fee. A Usb stick is best to use as they are small , can hold up to 2 gigabytes, reliable and also because most new computers are designed for them. The disadvantage is that they are easy to lose and expensive .In my opinion the good side outweigh the disadvantages. Viruses , Worms, Trojans and Spyware. A virus can be a file or a program that replicates itself in your computer. It can cause a lot of damage do your hard drive. E.g. a virus might infect a document, each time you open that document the virus runs and has a chance to cause harm. The Melissa Virus caused so much damage companies like Microsoft had to completely shut off their email systems. Viruses are mostly spread my emails, downloads off the internet (usually music and games) and backup devices (e.g. floppy disks). A virus can make you lose all your data! A worm is a computer program that can copy itself from machine to machine. Worms normally move around and infect other machines through computer networks. For example, the Code Red worm replicated itself over 250,000 times in approximately nine hours on July 19, 2001. Worms use up computer time and space. The worm also looks for security flaws. When it finds a computer that has a security flaw it copies itself into it. A Trojan horse is a program that looks desirable (like a game , screensaver) but is really dangerous. Hence the name. Trojan horses have the ability to erase files. They do not reproduce, they can be spread my email attachments, running a file from the internet etc. The often let hackers enter your computer who then can gain personal information (passwords). Spyware, which is also known an ad ware, collects information about the computer user without their consent. The usually collect personal information,, credit card details for advertising purposes. Spyware applications are typically bundled as a hidden component of freeware or shareware programs that can be downloaded from the Internet. Clicking on pop up ad sis a danger too. Spyware is often spread by email. When a computer has a bug is usually crashes a lot , is slow , has corrupted or deleted files , programs no longer work , a lot of error messages , has files that end in exe., ant virus program becomes disabled etc. Protection To protect yourself from these bugs its important that your install firewalls , virus scanners , Spam killers , privacy services and anti ad ware programs. Regularly scan your computer with your anti virus program. You shouldnt download programs off the internet particularly games and music as these are very popular. Also free programs. For an example Limewire is a popular program to download music . But because you are getting files directly from other people ( p2p program) you are prone to viruses . Also because Limewire doesnt scan the file you are downloading for a bug. When you receive an email from someone you dont know , do not open any attachments as they often have viruses. By wary of sharing usb sticks, floppies etc as these can store bugs too . Dealing with Errors and Copyright Laws. If you have a software problem it is best to contact the actual software company. And explain your problem :when it started , if you did anything different on your computer , what is the error message that arises etc. If there is a adware problem you should contact the company that made the computer e.g. Dell , IBM. Using their helpline. You could use your help and support centre that is already on your computer . Which is on the start menu. Or you could ring the help line, which is usually free. There are forums online and help sites that have qualified technicians there to help you to or you could just ring in for a technician and ask them to come in . You always as your teacher or friend to help you. There are often copyright laws on programs and software. These prevent people from making a copying or mimicking the product.(plagiarism). Copyright laws consist in a wide range of things e.g. poems, movies, drawings etc.

Why is New Mexico poor and what should be done about it Research Paper

Why is New Mexico poor and what should be done about it - Research Paper Example A very small part of Oklahoma also touches New Mexico in the east. Colorado is in the north of the state and Arizona is in its west. Republic of Mexico borders some parts of New Mexico in its south (Simmons 1-2). Historical Outlook The history of New Mexico is just like an adventure story. Thousands years ago, Indians were the first who settled there and developed their traditional way of living in the area. Next to Indians, Spaniards arrived and started living there with their own way of life. They had different set of ideas and customs as compared to Indians. In a short, it can be well said that Spaniards created a style of living and government on the footing of Europeans. Later on, Americans invaded the area and conquered the territory of New Mexico. Americans introduced their own way of living. So, through history it can be judged that several nations came over the territory of New Mexico leaving behind the life style of the people blended and more complex (Simmons 1-2). Economi cal Conditions of the Region Before enclosing the reasons of poverty in New Mexico, it is significant to have a look on the economic conditions of the region in general. New Mexico is most often described a very poor state among all other states of America. This description is correct if studied in the light of the average capital assets/ possessions of the total population. However, the natural as well as human resources of the state are far better as compared to average property count of the population. Over past few decades, the per capita personal earnings have remained constant. In the year of 1978, among 50 states of America, New Mexico ranked 43rd as far as comparative analysis of state per capita earnings were concerned. However, this figure lowers down from late 1970s onward. In 1990s, the per capita personal income allows the state to rank at 48th among 50 states of America. Later on, in 2000, this figure further goes down and New Mexico ranked 49th as far as per capita pe rsonal income is concerned. At that time, New Mexico was just above the state of Mississippi. In 2003, local estimates and statistics revealed that the ranking of New Mexico had raised to some extent, however, the Census Bureau still ranked the state of New Mexico at 49th. In 2004, Census Bureau also concluded that the wages paid to the workers were also the lowest with a great number of economically poor and depressed citizens as compared to any other state of America. The countries of Guadalupe, Mora and McKinley are at the lowest end of poverty and at the bottom of socio-economic scale in the region of New Mexico. These countries are mostly dominated with Indian and Hispanic populations. Being the poorer state in America, New Mexico always receives more shares from federal government as compared to what it contributes in the national income. In 1988, this state ranked second in terms of federal aid it received. However, in 2002, the conditions were bit changed and got some improv ements and New Mexico ranked fifth among the top aid receiving states. In addition, the people of New Mexico are taxed at a very high rate. Tax rate per capita is very high in the region when compared to their personal incomes. In 1987, the state of New Mexico ranked fifth among all other nations in percentage of the personal income of people paid for government fees and other taxes. In 2004, the state ranked eighteenth as far as the tax payment is concerned. However, tax collection does not produce fruitful results on the economy as the wages of the residents are very low. Revenue generated from taxes is not enough to cope with the economic pressures of the area- in order to minimize the federal assistance which is proved to be an imperative

It identifies the problems and recommends how an organization should deal with such problems related to communication. Communication Problems in an Organization Poor communication is a major problem in most organizations. It leads to failure of many projects, dissatisfaction of employees and eventually high turnover of employees hence causing huge losses to the organization. Poor communication also leads to lack of team work within the organization. This might result to low or dismal performance by employees. One major problem associated with poor communication is the lack of employees being informed about whatever is happening in the organization (Carroll, 2010). This ca n be facilitated by lack personal contact between workers and management. In most organization, there is a wide gap that exists between top managers and employees at the lowest level in the organization. As a result, it becomes difficult for information to flow effectively and efficiently from the top to bottom. Employees at the lower level stay in the dark, and they do not know what is happening. It is assumed that the modes of communication used can deliver important information to all employees. However, there are employees who do not use the modes of communication. For instance, where the top management is not in personal contact with the other employees, they might decide to use email as a mode of communication. Not all employees working in the organization have access to computers. Therefore, they do not use emails. It becomes difficult for such employees to be up to date about what is happening. It is imperative to note that the large gap in the organization has continued to increase especially with the advancement of technology. There is no personal contact since people are mostly using computers and cell phones for communication. Not all employees have access to these facilities. Managers who have excellent communication skills would prefer personal contact when communicating to their employees. The other problem associated with poor communication is the lack of clarity in the information received by employees from management (Carroll, 2010). It is very important for managers to communicate to their employees clearly. This is essential for successful communication to be effected. People are different and different employees interpret things in a different way. As a result, the managers need to clarify the issues they wish to communicate. Lack of clarity in information delivered by top managers might lead to different supervisors communicating messages that are conflicting to lower level employees. This leads to inconsistency of communication. There re sult is that there will be confusion among employees. This might affect the overall organizational performance. Poor communication also leads to luck of timely deliverance of information to employees. Employees do not get information when they need it (Carroll, 2010). This causes delays in decision making. It also delays projects especially if vital information is not received on good time. This is one reason that is likely to cause project failures. On the other
